1. Agreement to Terms

By accessing or using QuizCraft (“Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not access or use the Service. These Terms constitute a legally binding agreement between you and QuizCraft Inc. (“Company,” “we,” “us,” or “our”).

3. Educational Disclaimer and Limitation of Liability

3.1 Not a Substitute for Professional Education

• QuizCraft is NOT a replacement for formal education, professional instruction, or certified teaching
• Content is provided for general informational and entertainment purposes only
• Users should verify information with authoritative sources before relying on it for academic or professional purposes
• Teachers, students, and parents should use QuizCraft as a supplement, not a replacement, for curriculum

3.2 No Guarantee of Academic Results

We explicitly disclaim any guarantee that use of QuizCraft will result in:

• Improved academic performance or grades
• Success on standardized tests, exams, or certifications
• Mastery of any subject matter or skill
• Admission to educational institutions or employment opportunities
• Any specific learning outcome or educational benefit

3.3 No Liability for Educational Outcomes

To the maximum extent permitted by applicable law, QuizCraft, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for:

• Any failure in academic performance, exams, tests, or coursework
• Any decision made or action taken in reliance on content from the Service
• Any errors, omissions, or inaccuracies in educational content
• Any learning gaps or misconceptions resulting from use of the Service
• Any disputes between students, parents, and educational institutions regarding use of QuizCraft

4. User Accounts and Eligibility

4.1 Eligibility

By using QuizCraft, you represent and warrant that:

• You are at least 13 years old, or if under 13, you have obtained verifiable parental consent
• You have the legal capacity to enter into a binding contract
• You will comply with all applicable laws and regulations
• All information you provide is accurate, current, and complete

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Notify us immediately of any unauthorized access or security breach
• Ensure your account information remains accurate and up-to-date
• Not share, transfer, or sell your account to any third party
• Not use another user's account without permission

5. Acceptable Use Policy

You agree not to use QuizCraft to:

• Violate any applicable local, state, national, or international law or regulation
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Engage in any harassing, abusive, threatening, or harmful behavior toward other users
• Upload or transmit viruses, malware, or any code designed to harm or interfere with the Service
• Attempt to gain unauthorized access to any part of the Service or its systems
• Use automated scripts, bots, or scraping tools to access the Service
• Disrupt or interfere with the security, integrity, or performance of the Service
• Cheat, hack, or exploit bugs for unfair advantage in competitive modes
• Create multiple accounts to manipulate leaderboards, ratings, or rewards
• Upload content that is illegal, obscene, defamatory, or infringing on others' rights

Violation of this Acceptable Use Policy may result in immediate termination of your account and legal action where appropriate.

6. Intellectual Property

6.1 Our Rights

All content, features, and functionality of QuizCraft—including but not limited to text, graphics, logos, icons, images, audio clips, software, code, and the compilation thereof—are the exclusive property of QuizCraft Inc. and are protected by copyright, trademark, and other intellectual property laws.

The QuizCraft name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of QuizCraft Inc. You may not use such marks without our prior written permission.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial purposes.

6.3 User-Generated Content

By submitting any content to QuizCraft (including questions, feedback, or suggestions), you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

7. Subscriptions and Payments

7.1 Subscription Terms

Some features of QuizCraft require a paid subscription. By subscribing:

• You agree to pay all fees associated with your subscription plan
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• No refunds or credits for partial subscription periods

7.2 Free Trial

We may offer free trials of paid subscriptions. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends. Trial eligibility is determined at our sole discretion.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES
• THAT ANY INFORMATION WILL BE ACCURATE, RELIABLE, OR CURRENT
• THAT DEFECTS WILL BE CORRECTED
• THAT THE SERVICE IS FREE OF HARMFUL COMPONENTS

YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUIZCRAFT, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS
• ANY DAMAGES RESULTING FROM INTERRUPTION OF SERVICE, LOSS OF DATA, OR ERRORS
• ANY DAMAGES RELATED TO THIRD-PARTY SERVICES OR CONTENT

THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO CASE SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless QuizCraft, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit or share through the Service
• Any dispute between you and another user
• Any claim related to your performance on exams, tests, or academic work

11. Dispute Resolution and Arbitration

11.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at disputes@quizcraft.com with a description of your complaint and desired resolution.

11.2 Arbitration Agreement

Except for claims that may be brought in small claims court, any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Arbitration shall take place in San Francisco, California, unless otherwise agreed by both parties.

Class Action Waiver: Any proceedings to resolve disputes will be conducted only on an individual basis and not as a class action, consolidated action, or representative action.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Operational necessity or business discontinuation

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, disclaimers, indemnification, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California.

14. Severability and Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15. Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person other than the parties. Nothing in these Terms shall be deemed to create any third-party beneficiary rights.
